The Coparent App End User Licence Agreement

This End User Licence Agreement ("Agreement" or "EULA") is a legal agreement between you ("User", "you", "your") and Pittance LTD trading as The Coparent App ("Company", "we", "our", "us") regarding your use of The Coparent App, including our mobile applications, websites, services, content, updates, and related features.

By downloading, installing, accessing, creating an account, subscribing to, or using The Coparent App, you agree to be bound by this Agreement. If you do not agree, you must not use the Service.

1. Licence Grant

Subject to your compliance with this Agreement, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to download, install, access, and use The Coparent App solely for lawful personal co-parenting, family-management, or authorised professional-support purposes.

The app is licensed to you, not sold.

2. Eligibility

You must be at least 18 years old, have legal capacity to enter into contracts, provide accurate account information, and use the Service only for lawful purposes.

You may not create an account on behalf of another person without lawful authority.

3. Purpose of the Service

The Coparent App is designed to help separated parents, guardians, carers, and authorised professionals manage communication, parenting schedules, handover records, payments and shared expenses, documents and photos, child information, records and communication history.

The Service is not a legal service, medical service, mental health service, safeguarding authority, emergency service, or substitute for professional advice.

4. Subscriptions and Payments

Certain features require an active paid subscription. Subscriptions may include access to messaging, shared calendars, handover logs, secure document and photo storage, payment tracking, AI-assisted communication tools, export features, and voice or video meeting tools.

Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours before the current billing period ends.

Subscriptions may be managed or cancelled through your Apple ID or Google Play account settings. Refunds are governed by Apple or Google platform policies.

5. Free Trials and Feature Limits

We may offer limited free access, trial access, or restricted feature access at our sole discretion. Trial limitations may include restrictions on message counts, uploads, storage, AI usage, handover evidence, exports, and voice or video features.

6. AI-Assisted Features

The Coparent App may include AI-assisted features designed to rewrite messages, improve tone, reduce conflict, and improve communication clarity.

The app uses in-house application logic, moderation workflows, and proprietary prompt design. Certain AI text-processing features may use trusted third-party AI providers such as OpenAI, Anthropic, or similar providers.

AI processing occurs only when you actively choose to use an AI feature. By using AI-assisted features, you expressly consent to the submitted text being processed for that purpose.

AI-generated content may be inaccurate, incomplete, contextually unsuitable, or inappropriate. You remain solely responsible for reviewing and approving any AI-generated content before sending, relying upon, or acting on it.

7. User Content

You retain ownership of content you upload or submit, including messages, photos, documents, receipts, notes, handover evidence, and child-related records.

You grant us a limited licence to host, store, process, secure, back up, transmit, and display such content solely as necessary to operate and provide the Service.

You remain solely responsible for the content you upload.

8. Child Information

You are solely responsible for ensuring you have lawful authority to upload, store, or share any child-related information, including names, dates of birth, medical information, educational information, photographs, legal documents, and contact details.

We do not independently verify parental responsibility, custody arrangements, court orders, or legal authority unless required by law.

9. One-Device Account Policy

To help protect account security, communication integrity, and evidential reliability, each user account may be restricted to one approved device at a time.

If you replace your device, manual verification may be required before access is restored. Attempts to bypass this security measure may result in account suspension or termination.

10. Storage and Fair Use

Subscriptions may include secure storage for photos, documents, receipts, handover records, and related files. Storage is subject to fair-use limits.

We reserve the right to restrict excessive usage, prevent abuse, request content removal, offer expanded storage plans, or suspend uploads where misuse is suspected.

11. Prohibited Use

You must not use the Service to harass, threaten, abuse, intimidate, stalk, impersonate, mislead, defame, exploit, or unlawfully monitor another person.

You must not upload unlawful, harmful, abusive, misleading, malicious, infringing, irrelevant, excessive, or inappropriate content.

You must not attempt unauthorised access, reverse engineer the Service, bypass payment or security restrictions, or share your login credentials.

12. Emergency Features

Any emergency contact, notification, or override feature is provided as a convenience tool only.

We do not guarantee message delivery, push notification delivery, email delivery, SMS delivery, immediate receipt, or real-time availability.

Do not rely on The Coparent App during emergencies. In emergencies, contact local emergency services directly.

13. Records, Logs, and Exports

The Service may generate communication records, logs, and exportable reports.

We do not guarantee court admissibility, evidential acceptance, legal compliance in any jurisdiction, or acceptance by solicitors, mediators, courts, schools, healthcare providers, or public authorities.

You should obtain independent professional advice where appropriate.

14. Privacy and Data Protection

Your use of the Service is also governed by our Privacy Policy.

We process personal data in accordance with applicable privacy and data protection laws, including where applicable UK GDPR, EU GDPR, CCPA, applicable United States privacy laws, and applicable Canadian, Australian, New Zealand, and other local privacy laws.

Our Privacy Policy explains what data we collect, how we process it, how AI features process data, third-party processors, security measures, and retention periods.

15. Availability

We do not guarantee uninterrupted availability. The Service may be modified, updated, suspended, restricted, or discontinued at any time.

Maintenance, outages, platform restrictions, security events, or third-party failures may affect availability.

16. Account Suspension or Termination

We may suspend or terminate access if you violate this Agreement, payment fails, fraud is suspected, abuse is detected, security risks arise, safeguarding concerns are identified, or legal compliance requires suspension.

We may preserve records where legally required.

17. Intellectual Property

All rights in the software, branding, trademarks, logos, workflows, AI moderation systems, design, and content remain the property of Pittance LTD or its licensors.

You may not copy, modify, reverse engineer, resell, sublicense, exploit, reproduce, scrape, or create derivative works from the Service except where permitted by law or with our written permission.

18. Third-Party Services

The Service may rely on third-party providers including Apple App Store, Google Play, Amazon Web Services, push notification providers, video providers, email providers, analytics providers, AI providers, and payment platforms.

We are not responsible for third-party outages, policy changes, restrictions, or failures.

19. Export Compliance

You may not use, export, re-export, distribute, or transfer The Coparent App except as authorised by applicable export control laws, sanctions laws, and regulations, including those of the United Kingdom, the United States, the European Union, and any other applicable jurisdiction.

You represent that you are not located in, under the control of, or a resident of any country subject to applicable trade sanctions that prohibit your use of the Service.

20. Jurisdictional Restrictions

Certain features may not be available in all countries, territories, or jurisdictions.

We reserve the right to restrict, modify, disable, or remove features in order to comply with local laws, regulatory requirements, safeguarding obligations, platform policies, or operational limitations.

21. Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE."

We make no warranties regarding reliability, suitability, fitness for purpose, legal outcomes, AI accuracy, or uninterrupted operation.

22. Limitation of Liability

To the fullest extent permitted by law, Pittance LTD shall not be liable for indirect loss, lost profits, emotional distress, missed communications, missed handovers, relationship disputes, legal disputes, or user-caused data loss.

Our maximum liability shall not exceed the amount paid by you during the previous 12 months.

Nothing in this Agreement excludes rights or remedies that cannot legally be excluded under applicable consumer protection laws.

23. Indemnification

You agree to indemnify and hold harmless Pittance LTD from claims arising from your misuse, unlawful content, breach of this Agreement, or violation of another person's rights.

24. Apple App Store Terms

If downloaded through the Apple App Store:

  • Apple is not a party to this Agreement;
  • Apple has no obligation to provide maintenance or support;
  • Apple is not responsible for claims relating to the app;
  • Apple and its subsidiaries are third-party beneficiaries of this Agreement.

25. Google Play Terms

If downloaded through Google Play, your use of the app may also be subject to Google Play terms and policies.

26. Changes to this Agreement

We may update this Agreement periodically. If changes are material, we may notify users through the app, website, or email.

Continued use after changes take effect constitutes acceptance of the updated Agreement.

27. Governing Law

This Agreement shall be governed by the laws of Scotland, except where mandatory consumer protection laws in your country of residence require otherwise.

Nothing in this Agreement limits any statutory rights you may have under applicable consumer protection laws.

Any disputes shall be subject to the courts of Scotland unless local consumer protection laws provide otherwise.
